Pail SATURDAY, JANUARY 4.1890. • CORRESPONDENCE^ LEGAL. [CONDUCTED BY A BAFIAISREA-A R 1.AW.") Ltyal questIOns must b. stated fully ami clearly, and a full cepy must be sent of any decununt on which ndvice is sought. All communications must be endorsed LKGAL." BAST/.HDY ARREARS.—" M. J." (Cardiff; should apply to the magistrates for a warrant, upon which the reputed father must either pay up the amount of the arrears and costs of warrant or be taken to prison. Probably he would prefer to pay. LJOESSBD VICTUALLER.—If Cynon <Aberdare) will inform IJ5 the facts we shall be happy To advise him, liS we have advhed many other correspondents in this column on the same subject. But we always refuse to accept the incredible suggestion that allY sane roan would go to the expense of obtaining a licence and pretending to carry 011 the business in qupstion in order that he might have the pleasure of arbitrarily refusing to sell to his customers. BKTTING. A Constant Header" (Llandovery) is advised that bets cannot be recovered by means of legal proceedings. The propei course would be for the stakeholder to return each man the money deposited by him, and thus he would escape from any further responsibility. NOTICK BY EMPLOYJlR, Mountain Ash" is advised that one week's notice Is sufficient in the ease of a person employed and paid by the week, unless there should be any understanding or ciistom of the trade to the contrary. The case is net in any manner affected by the Act. of Parliament which be alludes to. COPY WILL.—" T. M." (Pontardawe) may write to the Record-Keepers, Probate Registry, Somerset House, London, W.C. If he ba,1 told us where the testator resided to the time of his decease, we would have told him to what district registry to apply, bat to give the whole list and the district of each registry would occupy too much space. ASSIGNMENTS OF LtA<moi.D8.—We cannot interfere between" Glwr (Treorky) and his solicitor. PROPOSED VOLUNTARY SKTTLEMKNT. — "6. Foster" (Abergavenny) should place this matter in the hands of a local solicitor. We assume that he is aware of the difficulty of defeating the bankruptcy laws by such devices. It would not be wise to throw away the costs of a settlement which would not stand the test. APPOIMTMBJVT OFNBW TRUSTEE.—(Swansea) has power to appoint a new trustee to act with him in the Place of the trustee recently deceased, lie (our corre- spondent) being the sole surviving trustee. The appointment will have to be made in a deed prepared ky a solicitor at the cost of the trust estate. £ MUTWOUS Cmtw AT PEHABTH."— Mr. E. W. Griffiths (Cardiff), writing throughout with a frank- ness which rendersjhis letter dangerous from the legal standpoint, condemns the sentence of two months in some instances and six weeks' hard labour In others inflicted upon fourteen sailors at Peiwrth. Our corre- spondent urges that shipowners should not be per- mitted to try these cases. NKOLKCTK) FBNCKS,—"Joseph" (Swansea) is advised that if the owner of a fence neglects to keep it in serviceable condition, and the sheep of his neighbour trespass upon his farm by reason of the defective fence, the owner of that fence has no legal remedy. He cannot claim damages fr..m the owner of the sheep, which have entered on his land at hie fnvitation by means of a gap left in hit own hedge. He may .1rlve them out and repair his fence. On the other ¡ Mud. it his cattle or sheep should trcepaes upon his iieigwwnr s intifl through the same fence, be would be iiafcie in damages for the injury done, because the trespass was his own fault. If be were < to do this he would be liable (o pay for the injury occasioned thereby. DK8RKTKD WJKR.—" Iago" is adviser! that the separate property of the wife canm t be taken in execution fur debts which have been incurred by her husband. His goods might be so taken at the suit of any ered\t»r who has obtained judgment against liim, for ",hidl purpose, if he has JlO: been served with proae?S in an action, ii would be necessary to li>,d him in ordev to j efltd. service. AMKHICAH PLIOUATK Okhci- — Minuesoia (Swansea) should as;, tho American Consul we have not the necessary local knowledge, lie is probably aware that there is no general probate registry in America corre- sponding to our Somerset Hou-e, but that, in each county wills and letters of adlllinistratioll may \;1.' se vched for ill all illdepenlk..i. oflice. BASTARDY. — Justice■" (Loughor) is advised to apply to the magistrates ftir all order of alliiiat iOIl. III the circumstances nieniioued tlie'e ,¡ 11 14 11 I, not tu be "ny difficulty. MANTKAI'S. See.—"ABC" (LUngadork) must hi)1 tbe any of these, "r tie rni:IJt render himself liable to penal servitude or imprisonment with hard !ab«u< PA'IKST MKl'lCINK.—" J." (Treliarrls) is informed that it !5 neither necessary i;«r proper :o obtain arty patent for a nwdieinal preparation, lie will have to obtai II a licence at the Inland Revenue ffice, for which he will pay 5s. per annum and place upon each packet of his remedy a stamp according to the selling price or Ihe same—1 1,1. 1s.. and so on, in ac ordance with the }.Hi,:e. No person ever doe5 obtain < patent for any- thing of he kind. LANM.OUD ANJI TEN* NT.—" Primrose League is advised thai, if tile no; ice is in accordance wii h the terms of the tenancy, ami was received on or before the rent day. it. is sufficient. but he forget t,) tell 115 whether t.hè tenan y is or is not. a quarterly one, or from what day of I he mouth it runs. HityvG )\(;nKIDII'1' A'canwr (Llalllri!allti is adviied to have his agieemcut ptepared by a local solicitor, who will want to know all the terms arranged, to enable him to draw ihe same. We could afford space to give even an outline of the requisite form, and the case is an important one. j PROPOSED DKH> ,,¡.- GIFT. Gower" (Swansea) is an vised to abandon hs intention of executing a deed of gift, which would have to he registered under the Bills of Sale Act, and the of which might, be more than the probate duly which would have to be paid after his decease in respect of his will, besides other disadvantages. It his wife were to die in his lifetime he wOld. I have to be put to more expense in order to get his property b ck again. A widow is not chargeable wi: h either legacy or succession duty in respect .f the real or persona; es ate of her deceased husband. PROPOSED SLTTLKMKNT. -As Sw mseaite is already a married man, he cannot make a marriage settlement, because it is essential lhat any such document should be executed before the marriage ceremony takes place. If he were to make a post-nuptial settlement, and tlleu 10 become bankrupt within two years after tht- date thereof, it wl)lIld be absolutely void. It would also be void if lie wire to become bankrupt within ten yell's afterwards, unless the property became al)50- lutely vested in the trustees from the time of execu- tion of the deed, and also unless those who might claim under such deed were in a position to prove that at, I lie t ime of execution thereof the sett lor was in a position to discharge all his liabilities without the assistance of the settled property. But-a deedexecuted for the avowed purpose of defeating an action and defrautiiug the plaintiff and preventing him from obtaining the fruits of his victory would in any cir- comstances be utterly void. We advise our cone-j spotident, to abandon the idea which he has mistakenly entertained. I'.NRKGISIERKD SOCIETY.—" Neath Abbey" is advised to withdiavv f"(l1tI the society in question, and join a respectable society which has been duly registered under t he Friendly Societies Acts. But. as he acknow- ledges that, there is a reason for the refusal, probably he would net be able to succeed iti his claim even it it could have been made against a registered society. He does not explain what is the reason for the refusal. BREACH OF CO.VTHACT. —We could not answer Ai.J.R." within the time mentioned, and as the matter appears to lie urgent, and he did not send us a copy of the CI1ll1,la<;l, al'eged to be broken (without which we could not advise hijn), we hope that before this can appear he w ill have placed the matter in the hands of a local solicitor. USE OF GU.V.—"Jonah" (Llanelly) may use a gun 011 the farm in I;is own occupation for the pllrpoeeof killing vermin or sc ring birds without having a gun licence or, if lie has such a licence, one of his servants may use a gun for the like purposes without any licence. If he wishes to shoot ground gain- hares or rabbits, he must have a licence. INHABITED IIOUSK L>UXR. A Martyr" fAberuare) is advised that this tax ought to be ass ssed upon the annual amount for which the house might reasonably be expected to let from year to year, the tenant pay- ing the usual rates and taxes, which would corre- spond with the gross estimated rental in the poor, ratebook. Therefore, if he is tenant from year to year at the full letting value, the assessment ought to correspond with his rent but if he holds the premises under a beneficial the annual value must be othetwise ascertained bv the commissioners of taxes. *w AUHKAKS OF RKST. — F. C." will have to bring all action to recover the amount which is due to him from his late tenant. If the tenant had removed his goods oitlier fraudulently or clandestinely in order to avoid a distress for rent then in arrear, our corrcspon- dellt. might have followed the goods and distrained upon them at any timt within 30 days after the date of removal, unless in the meantime such goods should have been actually sold to some person who had no knowledge or notice of the fraudulent removal, for in knowledge or notice of the fraudulent removal, for in such circumstances the removal would always be fraudulent, whether clandestine or not. But when our cot respond, nt gave the man leave to remove his goods before paying his rent, lie gave up his right to distrain for the arrears ancleven if he had not done so he would still have lost that right by lapse of time, as far more than thirty days have elapsed since the goods were removed, and nothing has been done in the matter by our correspondent. VKRBAL A«R«'KMBNT OF TENANCY.—There appears to be consideiablc misapprehension respecting the effect of a verbal agreement of tenancy, and yet the prin- ciple involved is as simple as it could well be. By vntue of the Statute of Frauds a verbal agreement for acquiring or disposing of any interest in land is absolutely void and incapable of being enforced by legal proceedings of any kind. But if possession should be given in pursuance of a previous verbal agreement it would be most unfair that such agree- ment should be ignored and. therefore, the tenant would hold the property upon the terms previously arranged verbally between the owner of the property and himself, and in pursuance of which his occupation as tenant had arisen. The reason for this grafting of the terms of agreement upon the actual tenancy, took effect from the time when possession was given by one of the parties and accepted by the other of them, is so obviously t'xir that there is no necessity for argument upon the question of its p opristv. DOMESTIC SERVANT'# NOTICE.—This is another of those simple matters of every-day life upon which we should think it impossible that any mistake should arise, were it not for the number of inquiries which we receive thereon. By universal custom every agree- ment for the hiring of a domestic, servant, bV the year is subject to this condition, that either of the parties thereto may put an end to such agreement at any time by giving to the other of them one month's notice to that effect, the wages in any such case being calculated and p-qid to the day 011 which the service actually cease9 and, in addition to this, the master (or mistress) has a right to determine the hiring at any time by payment of one month's notios given to the servant, who ill such ease gets one month's wages with the privilege of taking a new situation as soon as she has an opportunity of doing so, this privilege being considered equivalent to the month's board and lodgings. A servant may also be disiniseed without notice in case of gross misconduct, habitual ftisobe- dience or insolence, staying out at nights without leave, immorality, &c. In any case which .justifies instant dismissal without payment of wages in lieu of notice the current wages then in course of being earned are irrecoverable, because of Uie inconvenience which must lie suffered by the employer ill case of having to dismiss a servaut suddenly and unexpectedly without having any opportunity of engaging another in her place. The inquiries which we receive relate almost exclusively to female servants, but the remarks relating to notice and paym-nt in 1 en thereof apply equally to male domestics, although some of the causes which would justify summary dis- missal in one case would not apply to the other sex but u!)on these points we shall be happy to advise whenever the circumstances are clearly laid before us by any of our correspondents. COUNTY-COUNT ACTION. —" A Grocel" is not obliged to follow a debtor who, after obtaining goods on credit, has removed into another county-court district, but may sue him in his own district county-couit by leave of the registrar, upon two grounds. First, because the debt was incurred (technically, the cause of action arose) in that district. And, secondly, because the debtor has within six months now last past resided in that district. Or our correspondent might sue Uie debtor in the district to which he has removed with, out obtaining any leave at all, but as of right. NOTICE TO QUIT.—" A Landlord (Beaufort) has been wrongly Informed. Christmas Day is one of the usual quarter days, and, therefore, the giving of a notice to quit which is to expire on that day cannot be illegal. In case of a Christmas tenancy from year to year the notice must be given for that day. It is usual for possession to be given on the previous day, unlets by arrangement the tenant is allowed to re- main until the following day, but this would not be practicable if the house had been previously agreed to be let to a new tenant who wished to take posses- sion immediately. RIGHT OF WAY.—"Pembroke Cas'le" (Cardigan) is advised that no rilM of way could be successfully claimed in the circumstances suggested. COMPLAINT AGAINST OFFICER —If 11 Jean Âurus" (Tre- alaw) will inferm us the facts we shall be happy to advise him but we cannot afford space for answering indefinite inquiries. PROMISE TO GIVE AWAY PROPERTY.—The so-called agreement of which 6, An Enquirer" (Neath) has sent n8 a copy is really a promise, and it is not enforceable by means of legal proceedings. If the promisor is wise she will re-consider the matter, especially aftsr such an ungrateful return as the threat to compel her to give away her property before she knows whether she may or may not require it for her own use, Why sboald she run the risk of having to end her days in the workhouse? As our correspondent lias once got through the property, he has no right to expect to do so again at the expense fhis aged relative. We hope that she will take care erself.

11 .x-c.4.> WE ALL KNOW HIM. fEv CI.UE.mrK."] Mr. Rider Haggard's latest work has not received that flourish of trumpets which greeted some of his earlier efforts. It may not be generally known that on African subjects Mr. Haggard writes with more than the experience of a globe-trotter, for he spent some years of his early life in South Africa. At the age of nineteen he accompanied Sir Henry Bulwer to Natal as his private secretary, and subsequently served in a similar capacity under Sir Theophilas Shep- stone, her Majesty's Commissioner to the Transvaal, and took part in the temporary annexation of that territory to the British Crown in J877, and was afterwards appointed Master of the High Court of the Transvaal. At the commencement of the Zulu War h3 was adjutant-lieutenant of the Pretoria Horse. He began his career as author with Cetewayo and his White Neighbours" in 1882, and subsequently wrote "Dawn" and The Witch's Head," in which he gave promise of his success as a romance writer, which was fully realised in King Solomon's Mines." This won him the immense popularity which was still further enhanced by the publication of She."

LADY NAIL-TRIMMERS. Although manicures are increasing in London, the business is necessarily a small one, and it is kept very close. Now there are about a dozen pro- fessional lady nail-trimtnerp, but it is evident that they wouldn't care to teach the business. The majority of them are Americans, so there would be some difficulty for a learner. It fact, it seems that to successfully learn the business a woman would have to go to America, where a manicure is kept at every hairdresser's shop. Manicuring in London is like massage, nobody knows where it is taught.
