Aberdare School Board. The above was held on Friday. There were present Messrs. W. J. Heppell (chair- man), B. Lewis, J. Thomas, J. Watkins, W. Williams, D. P. Davies, J.P., Revs. C. A. H. Green, M.A., M.Powell, B.A., Canon Johnson, M.A.,T. Jones, J. Griffiths, and D.M. Davies, Messrs. J. Morris (clerk) and T. D. Jones (deputy clerk) PRECEPT.—It was decided to draw a pre- cept for £ 1,000. CONDOLENCE. The Chairman referred to the bereave- ment sustained by Sir W. T. Lewis and family through the lamented death of Lady Lewis. He said that they all recognised Sir William as the most prominent citizen of Aberdare. however much they differed from him on political and religious ques- tions. As lie stood pre-eminent in ability so did Lady Lewis in sympathy and charity. He would move that the Clerk send a letter of sympathy to the family. Mr. D. P. Davies seconded. The motion was carried unanimously, all the members upstanding. The Chairman also referred to the illness of their colleague, the Rev. W. James, the vice-chairman, and said that he was grati- fied '.to state that the latest news that he was recovering. He was sure that a vote of sympathy from the Board would cheer him on his bed of sickness. Rev. J. Griffiths seconded and the Rev. T, Jones supported the motion, which was unanimously carried. MORE PAY. The cleaner of Capcoch Schools made an application for an increase of salary.—The Chairman said that he did not see how they could entertain the application. The Capcoch cleaner was paid on an equal rate with all the others, and it was unfair to make any difference. Ultimately the appli- cation was rejected. The Aberdare Attendance 'Officers sought higher remuneration. They'contended that their salary was lower than that of officers of neighbouring Boards, who were also supplied with mackintoshes, uniform, &,e.- The Chairman said that these officials had received an increase a twelve months ago, and he considered that they were well paid. —Mr. W. Williams said that it reflected badly on their Board that they paid less than other Boards.—Mr. J. Watkins said that either their officers were underpaid, or other officers were overpaid. He would move that they provide their officers with mackintoshes and leggings in addition to their salaries.—The Rev. T. Jones seconded the motion, which was carried. TOWN SCHOOLS.—A letter was read from the Aberdare Teachers' Associatiod asking for the use of the Town School to hold a meeting pertaining to that Association.— Granted. MEASLES AND EDUCATION.—It was reported that there was an outbreak of measles at Aberaman, and the advisability of closing the schools there was discussed.—Rev. M. Powell proposed that the schools be closed provided that a medical certificate be first obtained.—Vicar Green seeonded.-iNIr. J. Watkiu moved an amendment that the matter be deferred for a fortnight.—The amendment was carried by six votes to five. TENDERS.—For the Park School extension contract there were five tenders. That of Messrs. J. Morgan and Son, Aberdare, at £ 3,189 was accepted.—Only one tender for supply of coal to the various schools had been received, namely that of the Graig Coal Co., Aberdare. The Chairman deemed the prices reasonable, and it was accepted without opposition. ABSENTEE TEACHERS.—In accordance with a notice given at the last meeting the Chairman moved that henceforth if the absences of a teacher exceed ten days the pay should be forfeited for the excess, and that the days should be cumulative and not consecutive as heretofore.—Mr. B. Lewis seconded, sayiug they were only acting on the same principle as friendly societies.— The proposition was unanimouslv carried. APPOINTMENTS On the motion of Mr. D. P. Davies, seconded by Rev. J. Griffiths. Miss Agnes Jones was appointed head- teacher at Cwmdare Schools. Miss Ethel M. Thornley. of Nottingham School, was appointed assistant mistress at Cwmaman Infant School. THE ABSENTEES AGAI-N.-Tlie Clerk read a long list of teachers who had been absent frequently and for lengthy periods.—The Chairman said that that was sufficient to justify the motion they had just passed, In many cases the teachers that were ill had not 'produced a medical certificate.— Mr. B. Lewis said the least they could do was to give a certificate.—Ultimately it was decided that in future a doctor's certificate would be required after two days' absence. MISCELLANEOUS.—The plans of Roberts- town School had been returned from the Board of Education revised, and it was de- cided to apply for tenders.—The application of the District Council for the consent of the Board to erect a urinal in the boundary of the Park School was granted.
The Rate Anomaly.
The Rate Anomaly. The Clerk of the District Council's Report. Town Hall. Aberdare. October 10, 1902. To the Chairman and Members of the Urban District Council of Aberdare. Gentlemen. In accordance with the resolution passed at your last meeting I beg to report upon the mode or basis upon which the General District Rate is ascer. tain and assessed, more particularly so when dealing with Small Tenements where the rateable value of any premises liable to assessment does not exceed £ 10 per annum. In the first place I have to point out that all kinds of property are assessable to the General District Rate on the value as as- certained by the valuation list for the time being in force. This Valuation List is pre- pared by the Overseers, and after certain legal formalities, confirmed by the Assess- ment Committee of the Union, then comes into force, and your rate is based thereon. Now as to the General District Rates generally they are to be made and levied on the" occupiers" of all kind of property, but in dealing with Small Tenements the Urban Authority may at their option rate the owner and in doing so adopt one of two courses:— (a.) Assess the owner on such reduced estimate as the Urban Authority may deem reasonable of "the net annual value not being less than two-thirds or more than four-fifths of the net value, or (b.) "Where such reduced estimate is in respect or premises, whether occupied or not. then the assessment must be on one-half the amount at which such tenements would be liable to be rated if the same were occupied and the rate levied on the occupiers. The effect of the above is that the Council can in dealing with Small Tenements adopt one of three courses, viz:- (1) Assess the occupier and collect the rate from him for such period only as he shall occupy. (2) Assess the owner, allowing one, third or one-fifth, he also paying for such period only as the premises shall be actually occupied. (3) Assess the owner at one-half, he pay- ing the rate whether the premises are occupied or not. The latter course is the one which has been adopted by your Council for many years—indeed as far as I have been able to ascertain, this was so from the passing of the Public Health Act, 1875, and even before, for a somewhat similar provision was made in the Acts in force prior to the passing of the Act of 1875. The reason for this is given by one learned Judge in discussing the Section under notice is "That the owner may be receiving no rent for a portion of the premises for which he is, neverthe- less. rated, it has been provided that he is to be rated on only half the rateable value. On the one side the Urban Authority secures the payment of the rate by a sub- stantial person, while on the other hand the Owner is in such a case protected from being called on to pay upon more than half the Rateable value. This construction seems to be reasonable and just." Another feature to which my attention has been directed was the position of a person who was the owner as well as occu- pier of a house. The practice in this district has been that when this was the case the person was rated as an Occupier" and paid upon the full rateable value without any deduction. I then expressed an opinion that this was the proper and legal course, I have since further investigated and con- sidered the matter, and am confirmed in my view. in which I am fortified by the decision of a Stipendiary Magistrate upon the point, and in the reiterated expression of opinion of an Author of a standard legal work,- I remain, yours obediently, THOS, Phhufb, Ctedfr
