The application was made under the 31st section of the net, which empowered the Lord Cilan- cellor, the Master of the Rolls, and Vice-Chanccllors. to reverse, discharge, or after the decrees ur orders of the Court of Exchequer, as if they hud been oriillally pronounced by the Court of The VICE-CHANCELLOR said, that lie had had a conversation with the Lord Chancellor, and the im- pression on his (the Vice-Chancellor's) mind was, that his Lordship would be willing to hear any case of the description before the Court, where the point in ques- tion involved in fact an appeal from a decision ol the Lord Chief BJIOD or Mr. Baron Alderson. But that he the Vice-Chancellor had a gieat objection, unless he were bound to do so, to enter upon the discussion of any case upon which th>se eminent lawyers had alrea- dy pronounced their opinion. Mr. PiMpKiXsoN stated, that as he un(It,rslood the case an ord-r had been originally made to commit the defendant. That the defendant was brought up by writ of habeas corpus for his discharge. That sut h motion was opposed, and ultimately refused, witii c.ists. The defendant now gives notice of moiionfor his discharge, and that the order of the Lord Chief Baron mijcht be discharged or varied as t lie Court might think fit in fact beinsf no other, no more nor less, than an appeal from a decision of the Lord Chief Baron. The I have already said, I would rather not interfere in a case in which the Lord Chief Raron has already decidl.d unless indeed, it be my duty to do so Rut as the Lord Chancellor is willing to hear such motions, it had better be made before him. Where however, all application does not so interfere, I feel bound to hear it. EX PARTE FIELD. Mr, ELMST.EY moved for the issue of a writ of distringas to the Bank of England to prevent the transfer of certain stock. He stated that the motion was m,ide under the 4th section ol the above cited act, which gave the Court of Chancery the jurisdiction which belonged to the equity sido of the Court of Exchequer. The VICE-CHANCELLOR.—There is also the 5th sec- tion, and some have thought that one of them issnper- fluous. If the r»i.~iiai)-is-made under-tfee- 4th, which gives the jurisdiction to this Court of a summary means of distringas withont bill filed, I should like to know the practice of the Court of Exchequer. Mr. EL:WsLEY.- Tbe practice of that court was. that the officer, on application to him without bil 1 61ed, and without anv interference of the Court, to issue the distringas and lodge it at the Bank. If then the party claiming to transfer applied for snch purpose, the Rank would notify to the party lodging the distringas that lie must get an injunction from the Court for the same purpose as that for which the distringas was lodged, or that the stock would be transferred.
