For the maintenance and management of ,the Llandudno Pier in the County of Car- narvon for authorising a widening thereof; for repealing the Llandudno Pier Orders 1876 1880 and 1882; and for other purposes. PRELIMINARY. SHORT TITLE.— 1. This Order may be cited as the Llandudno Pier Order 1908. COMMISSI CEMENT.—2. This Order shall come into operation upon the day when the Act confirming this Order is passed and that, day is in this Order re- fered to' as the commencement of this Order. UNDERTAKERS. 3. The Llandudno Pier Company Limited shall be the undertakers for carrying this Order into execution and are in this Order referred to as "the Com- pany." ACQUISITION OF LANDS. INCORPORATION OF' ACTS.—4. The Lands Clauses Acts (except so much thereof as relates to the purchase and tak- ing of lands otherwise than by agreement ,and to the entry upon lands by the pro- moters of the undertaking) are hereby in- corporated with this Order and for the purposes of that incorporation the term "Special Act" in those Acts, shall mean this Order. POWER TO TAKE) LANDS BY AGREEMENT.—5. For the purposes of the works authorised by this Order the Company may purchase by agreement and use all or such parts of the lands shown on the plan deposited for the purposes of those works. POWER TO GRANT; EASEMENTS.— 5. For the purposes of the works author- ised by this Order the Company may pur- chase by agreement and use all or such parts of the lands shown on the plan de- posited for the purposes of this Order as they may think requisite for the purpose of those works. POWER TO GRANT EASEMENTS. -6. Persons empowered by the Lands Clauses Acts to sell and convey or release lands may if they think fit subject to the provisions of those Acts and this Order grant any easement, right or privilege (not being an easement right or privilege of water in which other persons than the grantors have an interest) required for the purposes of this Order in over or affecting any such lands and the provisions of the said Acts with respect tc lands so far as the same are applicablei in this behalf shall extend and apply to such grants and to such easements rights and privileges as aforesaid. WORKS AND POWERS. MAINTENANCE! AND EXECUTION OF WORKS.—7. The Company may maintain their existing pper and the pavilion and aJl other works and build- ings belonging to them in Llandudno in the County of Carnarvon and subject to the provisions of this Order and subject to such alterations (if any) in the plan and sections deposited in reference to this Order as the Board of Trade may require or sanction before completion of the works the Company may on the lands be- longing to them or acquired under this Order and in the lines and according to the levels and within the limits of devia- tion shown on the said plan and sections execute and maintain a widening of the said exiisting pier for a width of thirty feet on the north side thereof or fifteen feet on each side thereof commencing at the old toll gate and! from: thence proceeding to and round the landing place at the end of the pier. LLANDUDNO PIER. POW EiR, TO DEVIATE,- 8. In con- structing the works authorised by this Order the Company may with the consent in writing of the Board of Trade deviate laterally to any extent within the limits of deviation marked on the deposited plans and may with the like consent deviate vertically to any extent. POWER TO IMPROVE: WORKS.—9 (1). Subject to the provisions of this Order the Company may from time to time with the consent of the Board: of Trade improve alter and extend the pier and works and may in connection with the same respectively construct maintain alter and improve embankments landing places piers quays jetties wharves beaches for hauling boats buoys moorings: lights beacon roads sewers drains watercourses main pipesi wires engines weighing machines and other works and apparatus and conveniences which may be found necessary for carrying on the busineissi of the Company and for the accommodation of vessels and traffic and may also from time to time lay down and maintain rails tramways sidiings and turntables on and along the pier works and land connected therewith and may provide motive power for tramways and may take down or re- move portions of the existing works. (2) No line of rails or tramway con- structed under the powers of this Order ,shall be used for the public conveyance of f passenges unless and until the same shall have been inspected: and certified by the Board of Trade to be fit for such traffic. CONSENT OF BOARD OF TRADE! TO WORKS'.—10'. No part of the works authorised by this Order below high-water mark shall be commenced without the consent, in writing of the Board of Trade and those works shall be executed only in accordance wth the terms of such consent. PENALTY FOR OBSTRUCTING WORK,Sv—11. Any person who wilfully obstructs any person acting under the authority of the Company in setting out the lines of the works authorised by this Order or who pulls up or removes any poles or stakes driven into the ground for the purpose of setting out the lines of those works shall for every such offence be liable to a penalty not exceeding five pounds. POWER TO' CEASE IN CERTAIN EVEJN'T'S.12. (1) If within two years from the commencement of this Order the pier widening authorised by this Order is not substantially commenced the powers given by this Order for executing the same or otherwise in relation thereto shall cease unless the time for the commence- ment of the same be extended by the special direction of the Board of Trade. (2) If the pier widening authorised by this Order after having been substantially commenced is virtually suspended for twelve consecutive months the powers by this Order given for executing the same or otherwise in relation thereto shall cease except as to 'so much of the same as has then been 'completed unleiss those powers are by the special direction of the Board of Trade continuedi and directed to remain in force for any period not exceeding five, years from the commencement of this I Order. I (3) In either of the above cases a certi- ficate from the Board of Trade to the I effect that the pier widening has not been substantially commenced or that the works have been virtually suspended for twelve consecutive months shall for the purposes of this Order be conclusive evi- I dence of the facts in such certificate,. POWER TO EREICT PAVILIONS I AND OTHIERi BUILDINGS.—13. The Company may (if and so far as authorised I by the Company's Memorandum of Asso- ciation) construct a,nd maintain on the pier or on any lands for the time being be- longing to them and may furnish stock 1 and equip- and may make such reasonable charges as they think fit for the use of and admisision to pavilions saloons assembly concert lecture waiting refresh- ment reading and other rooms: automatic machines bicycle stands band stands shop bazaars kiosks aquaria and other buildings for recreation or entertainment water closets urinals lavatories baths and other I conveniences: Provided that without the consent in writing of the Board of Trade no bulilding of any kindi shall be erected or placed on that portion of the pier which lies between the existing pavilion and the southern entrance to the pier. POWER TO DREDGE.—14. (1) The Company may deepen dredge scour- ami excavate any portion of the foreshore and bed of the isea. to the extent necessary to secure a sufficient waterway and approach I I to the pier for vessels using the same. (2) All sand mud: and other ate,rials dredged up or removed under the powers II of this Order shall be the property of the Company and they may sell or otherwise dispose of or remove or deposit the same, as they think fit: Provided that no sand mud stone or other material shall be laid down or deposited in any place below high- water mark without the consent in writing of the Board of Trade having been first obtained. (3) All money ar; sing from any sale or other disposition of sand mud and other materials, under this section after pay- ment of the expenses connected therewith shall be -applied! in the same manner as the revenue, received from rates under this Order is to be applied. POWER TO PURCHASE, OR, HIRE DREDGES, &c.-15. The, Company may for the purposes of this Order provide pur- chase lease or hire such steam or other dredgers engines tugs lighters or other vessels diving bells tools plant or other material as they may think fit and may de- mand and receive such reasonable, sums for the use of the same as they may think fit or may sell or dispose, of the same, and the money realised by any isale thereof shall be applied towards carrying into ¡ effect any of the purposes of this Order to which capital is properly applicable'. METERS AND WEIGHERS.—16. The Company shall have the appointment of meters and weighers on or in connec- tion with the pier and works. POWER TO1 MAKE BYE-LAWS.—17. (1) Without prejudice to the power to make bye-laws conferred by Section 83 of the Harbours Docks and Piers Clauses Act 1847 the Company may make bye- laws — For the, control of veissels persons animals and vehicles resorting to or fre- I quenting or using the pier: For the prevention of nuisances and annoyances Generally for the management regula- tion and use of the pier and of the conduct of persons using the same. (2) The bye-laws may provide for im- posing a penalty not exceeding forty shil- lings for the breach or non-observance of any of the bye-laws. (3) No bye-laws shall come into opera- tion until it has received the allowance and confirmation of the Board of Trade and tha,t allowance and confirmation shall be sufficient for all purposes. (4) Sections 84 and 85 of the Harbours Docks and Piers Clauses Act 1847 shall not be incorporated with this Order. RATES. POWMtflX) LEVY RATES.—18. Not- withstanding Sections 25 and 26 of the Harbour Docks and Piers Clauses Act 1847 the Company may subject and according to the provisions of this Order forthwith after the commencement of this Order demand receive and recover for the use of the pier and the works and conveniences connected therewith and in respect of ves- sels boats persons goods minerals animals fish and things and for services described in the Schedule to this Order any rates not exceeding those specified in that Schedule. POWER TO' VARY EIXEiMPTIONS AND COMPOUND FOR, RA,TES.19;. The Company may confer vary or ex- tinguish exemptions from and compound with any person with respect to the pay- ment of rates or charges authorised by the Schedule to this Order but so that no pre- ference bei in any case given to any per- son over any other person using the pier or works under the like circumstances and that anything done under this section shall not prejudice, the other provisions of this Order. POWER; TO' SELL.—20. (1) At any time after the works have been completed the Company may (if authorised so to do by their Memorandum and Articles of Association and subject to the powers and provisions thereof) with the previous con- sent in writing and upon such terms con- ditons and restrictions as may be sanc- tioned by the Board of Trade- to sell their undertaking and the purchaser to the ex- tent authorised by his conveyance shall have and may exercise all or any of the powers, conferred upon the Undertakers by this Order which the Company have or might exercise under this Order and shall be subject to all the liabilities and obligations to which the Company are sub- ject and shall perform all the duties of the Company under this Order. (2) The Company shall within one month after the date, of any conveyance made under this section deposit a certified copy thereof respectively with the Board of Trade and shall as from the expiration of that month be liable to a penalty not exceeding twenty pounds for every week or part of a week during which they re- fuse or neglect to comply with this sub- section. POWIEiRTO LEASE UNDERTAKING OR RATES.—21. (1) The Company may with the previous consent in writing of and upon terms conditions and restrictions and for such period ais may be sanctioned by the Board of Trade lease to any Company Corporation or person (A) the entire undertaking of the, Company or (B) the rates and other charges authorised to be zn taken by this Order. (2) As from the date of any lease made under the last preceding subsection the Lessee during the continuance of and to the extent provided in his lease shall have and may exercise all or any of the- powers conferred upon the Company by this Order which the, Company have or might, exercise under this Order and shall be subject to all the liabilities and obliga- tions to which the Company are subject and shall perform all the, duties of the Company under this Order. (3) No lease made under Subsection 1 of this section shall be assignable without the previous co-nsent in writing of the Board of Trade.' (4) The Company shall within one month after the date of any lease made under this section deposit, a, -certified copy thereof respectively with the Board of Trade and shall as from the expiration of that month be liable, to a penalty not ex- ceeding twenty pounds for every week or part of a week during which they refuse or neglect to comply with this subsection. (5) DNa lease made under this section shall be made in consideration or part consideration of any fine premium or other capital sum. (6) Nothing in this section shall exempt, the Company from their obligation to keep and render accounts and as from the date of any lease made under this section all the provisions of the, Acts incorporated with this Order and of this Order a,s to the keeping delivery and audit of accounts shall apply to and be binding, upon as well I the Lessees as the Undertakers and all! moneys received by the Company under or in respect of any such lease shall be deemed to be moneys levied by virtue of and income under this Order. 1 POWER TO LEASE, PAVILIONS, &c.—22. The Company may let for hire or lease for any term not exceeding seven yeas any pavilions rooms shops ba,ths sheds warehouses or other buildings separately from any other part of the undertaking to any Company 'Corporation or person upon such terms pecuniary or otherwise and under such restrictions and conditions, -as they think fit. RA.TBS; FOR, WAREHOUSES, &c. 23. The Company may (so far as the rates specified in the Schedule to this Order do not extend) demand and recover such rates or other consideration as they think reasonable for the use of any warehouses sheds buildings, yards weighing machines mooring posts cranes buoys works and conveniences belonging to or provided by the Company or in respect of any services rendered by them in connection with the pier. SUPPLY AND RATE, FOR, WATER. -24. If and so long as the Company shall make and maintain such provisions and appliances as may be necessary for fur- nishing to. vessels resorting to the pier a supply of pure and wholesome water the Company shall be entitled to make and re- cover such reasonable charges as they may think fit not exceeding the rate specified for that purpose, in the Schedule to this Order for pure and wholesome water sup- plied by them. t> S2^?,;D of may reduce RATES.- 25. If at any time the clear annual income derived from the rates specified in the Schedule to this Order on the average of the then three last preced- ing years after payment of all expenses i and outgoings other than payments of in- terest or principal in respect of money borrowed exceeds the amount required to pay interest at the rate of ten pounds per centum per annum on the entire sum from time to time appearing to the Board of Trade to have been expended by the Com- pany in constructing and improving the pier including the works authorised by this Order the Board of Trade may if in their discretion they think fit reduce the rates leviable under this Order to such amounts as will be sufficient to provide the amount aforesaid and such rates shall be reduced accordingly with power never- theless to the Board of Trade at any time and from time to time thereafter to raise the rates again to any sums not exceeding the rates specified in the Schedule to this Order. CERTAIN FISHING VESSELS UN- DER STRESS OF WEATHER, EXEMPT FROM RATEIS.26. Fishing vessels be- longing to countries, with which for the time being treaties exist exempting from duties and port charges such vessels when forced by stress of weather to -seek shelter in ports Or on the coasts of the United; Kingdom shall when forced by stress of weather to make use of the pier and works authorised by this Order and not breaking bulk while making use, thereof be, exempt from rates leviable, under this Order. EXEMPTION OF LIFEBOAT CREW. 27. All pesons going to or returning from any lifeboat or using any -apparatus for saving life and being persons either be- longing to the crew of the lifeboat or to the coastguard or being persons for the time being actually employed in saving life, or in exercising or using the lifeboat or the apparatus for saving: life and all persons brought ashore from any vessel in distress shall at all times have free in- gress passageandegresSi to along and from the premises and works belonging to the Company. PASiS: AND FAMILY TICKETS.— 28 (1) The Company may grant to. pas- sengers and promenaders or others for the use of the pier (either exclusively or not of any building or room for the time being thereon) pass tickets or family ticketsa,t, such rates on such terms and for such periods not exceeding -one, year as may be agreed upon and may issue books containing any number of pass tickets at a reduced! rate and day tickets available- for one day or part of a day only but for any number of admissions on such day or part of a day at a reduced rate but so that no preference he given to any person. (2) The Company shall have the power t.'1 prescribe the conditions on which family tickets are issued, and the, persons by whom such tickets may be used. (3) A pass ticket shall not be transfer- by whom such tickets may be. used. (3) A pass ticket shall not be transfer- able and shall not be used by any person except the person to whom it is granted. No pass ticket or family ticket shall be used otherwise than in accordance with the conditions on which it is issued or after the period limited for its use. (4) There shall be printed on every pass ticket and family ticket the terms and conditions upon and subject to which the same is issued. (5) If any person wilfully and with in- tent to defraud acts in any way in contra- vention of the provisions of this section or uses or attempts to use- any false or coun- terfeit ticket he shall for each offence be liable to a, penalty not exceeding twenty shillings. 'SPECIAL rates; ON concert NIGHTS, &c.-29. (1) Notwithstanding anything contained in this Order the Com- pany may charge for every person using the pier between the hours of 6 p.m. and ( 10 p.m. on any day on which a concert or other public entertainment is held in the pavilion for at least one and a half hours between the said) hours of 6 p.m. and 10 p.m. any sum not exceeding sixpence. (2) The special rate charged under this section shall be in lieu of and not in addi- tion to the ratei specified in the schedule to this Order for using the pier and any person paying the sa,id sum of sixpence shall be entitled to admission to the pavil- ion (but not to admission to any reserved seat) without extra charge. (3) This section shall not apply to the Master or any member of the crew of any vessel boat or wherry using the pier for the purpose of going to or returning from his own vessel boat or wherry and not seeking admission to the pavilion. ACCOUNTS. ANNUAL, ACCOUNT TO BE. SENT TO THE BOARD OF TRADE.—30. (1) The Company shall within one month after sending to the Clerk of the Peace a copy of their annual account in abstract- send a copy of the same to the Board of Trade and the sixteenth section of the General Pier and Harbour Act 1861 i Amendment Act shall apply to and in- clude any such account. (2) The account shall be made- up to the end of the thirty-first day of March in each year. (3) The Company shall a& from the ex- piration of that month be liable to a u penalty not exceeding twenty pounds for. every week or part of a week during which they refuse or neglect to comply with this section LIFE-SAVING APPARATUS. PROVISION FOR, LIFE-SAVING APPARATUS.—31 (1) Sections 16 to 19 inclusive of the Habour Docks and Piers Clauses Act 1847 shall not be in- corporated with this Order. (2) The Company shall whenever re- quired by the Board of Trade provide at their own expense and to the satisfaction of the Board of Trade a site on or near the pier and erect on that site a house or other proper accommodation for a, lifeboat rocket apparatus and other life-saving apparatus. (3) If the Company fail to comply with this section they shall be liable to a penalty not exceeding ten pounds for every month during which the- failure continues. LIFE-SAVING APPARATUS MAY BE ATTACHED TO PIER,—32. The officers of the coastguard and all other persons for the time being actually em- ployed in connection with the lifeboat or te apparatus for saving life may either permanently or temporarily without pay- ment attach or cause to be attached to any part of the pier spars and other apparatus for saving life and may also either in course of using or of exercising the apparatus for saving life fire rockets over the pier. LIFE-BUOYS TO BE KEPT.—33. The Company shall at all times keep- at convenient places on the pier and in obedience to any requirements which may be made by the Board of Trade life-buoys and life-lines in good order and fit and ready for use. LIGHTS. LIGHTS DURING CONSTRUCTION OF WORKS.—34. (1) Before com- mencing the works authorised by this Order the. Company shall apply to the Board of Trade for directions as to the lights to be exhibited and other means to be taken for preventing danger to navi- gation and shall in all respects obey any directions given upon that application or afterwards from time to time given as to the like matters, by the Board of Trade, during the construction of the works and compliance with the directions so given shall satisfy and be in place of every other n n statutory requirement as to lights during the construction of the works. (2) The Company shall be liable to a penalty not exceeding ten pounds for every day during which they omit so to apply or refuse or neglect to observe or comply with any directions so given. LIGHTS AFTER COMPLETION OF WORKS.—35. (1) After completion or permanent discontinuance or abandon- ment of the pier widening authorised by this Order the Company shall exhibit at the outer extremity of the works or the. L.)T completed portions thereof or in such other places as may be required from sun- set to sunrise and according to the- re- quirements of the traffic and the season of the year such lights (if any) and shall take such other steps for the prevention of danger to navigation as shall from time to time be directed by the Corporation of Trinity House Deptford S-trond and shall apply to that Corporation for such direc- tions as to the means to be taken. (2) The Company shall be, liable to a. penalty not exceeding ten pounds for every day during which they omit so to apply or refuse or neglect to observe or comply with any such directions. MISCELLANEOUS. APP LI CIATION] OF' HARBOURS CLAUSES ACT 10 and 11 VICT c 27.— 37. For all the purposes of the Harbours Docks and Piers Clauses Act 1847 this Order shall be deemed the Special Act. RESTRICTIONS AS TO MOORING VESSELS, &c.-38. No vessel or boat except steamboats and pleasure boats em- barking and disembarking passengers and their luggage shall be allowed to be moor- ed alongside the pier without the consent of the, Company or their pier-master. EXEIMPTIONS AND SAVINGS FOR GOVERNMENT DEPARTMENTS.—39. Sections 28 and 99 of the Harbours Docks and Piers Clauses Act 1847 as incorporated with this Order shall apply to and for the benefit of any Government department in the same manner as they apply to and for the benefit of the Government departments specially named in those sections. SAVING RIGHTS OF CROWN.—40. Nothing in this Order affects prejudicially any estate right power privilege or exemp- tion of the Crown and in particular noth- ing herein contained authorises the, Com- pany to take use or in any manner inter- fere with any portion of the shore or bed of the sea or of any river channel creek bay or estuary or any lands hereditaments subjects or rights of whatsoever descrip- tion belonging to His Majesty in right of His Crown and under the management of the Commissioners of Woods or of the Board of Trade respectively without the consent in writing of the Commissioners of Woods or the Board of Trade as the case may been behalf of His Majesty first had and obtained for that purpose (which consent those Commissioners and that Board are hereby respectively authorised to give). WORKS TO BE IN PARISH OF LLANDUDNO1.—41. The works authoris- ed by this Order shall be deemed, to be ————— for all purposes within the parish of Llandudno in the County of Carnarvon. REPEAL. REPEAL OF ORDERS AND BYE- LAWS.—42. (1) The Llandudno Pier Order 1876 the Llandudno Pier Order 1880 and the Llandudno Pier Order 1892 are hereby repealed. (2) Notwithstanding that repeal any bye-laws made under the, powers of those Orders or any of them and in force at the commencement of this Order shall con- tinue in force for one year from the com- mencement of this Order but shall then cease to have effect and be repealed. (3) The repeal of the said bye-laws shall not affect any penalty forfeiture or punishment in respect of any offence against those bye-laws committed before the date -on which those bye-laws cease to have effect and are repealed. COSTS. COSTS OF ORDER,—43. All costs charges and expenses of and incident to the preparing and obtaining of this Order and otherwise incurred in reference there- to shall be paid by the Company.
