ACTION AGAINST MR. HALL CAINE.
ACTION AGAINST MR. HALL CAINE. In the King's Bench, Mr. Montagu Vivian Leveaux, theatrical manager, sued Mr. Hall Caine, the author, for breach of contract to grant himself and Mr. Derwent Hall Caine the sole and exclusive right of producing a play. Mr. Hall Caine's defence was that his health had not enabled him to complete the play, and said that the agreement was subject to the im- plied condition that his health allowed him to finish it. At the first day's hearing Mr. lush, K.C., for Mr. Leveaux, said that the contract related to a play at first entitled "Home, Sweet Home," or "Jan the Icelander," and subsequently altered to "The Unwritten Law." A contract was entered into under which Mr. Hall Caine was to deliver to the managers, Mr. Leveaux and Mr. Derwent Hall Caine, the sole exclusive rights of production thereof for the United Kingdom (exclusive of London, where it was to be produced by Sir Herbert Tree), Ireland, Channel Islands, and the Isle of Man, for five years from January 1, 1909, the con- sideration being that the managers agreed to pay to the author 5 per cent. on the gross weekly receipts up to A200, 7$per cent. above £ 200 and up to £ 400, and 10 per cent. above J100. Mr. Derwent Hall Caine was to have £10 a week and one-third of the profits, and Mr. Leveaux, who was to finance the tour, was to receive the remaining two-thirds. The essence of the contract, said Mr. Lush, was that Mr. Hall Caine agreed to hand over the full manuscript of the play by November 1, 1908. The contract did not say that Mr. Hall Ca-ine W:H going to write a play, but des- cribed him as "the author." In the witness-ljox on the following day Mr. Hall Caine explained how a couple of motoring mishaps had had such a disastrous effect on his nerves that he was compelled to go away to St. Moritz to recuperate. When the case was resumed on Thursday, Mr. Hall Caine, recalled, said that after the rising of the Court on Wednesday a communica- tion was made to him, to his great surprise, that a copyright performance of his play had taken place in the North ten years ago. He had taken the greatest pains to find out what happened at that time, and had come across an entry in "The Stage" cyclopaedia which ran as follows: Jan the Icelander; or" Home, Sweet Home (the former title of the play), d. (drama), 3 A. (3 acts), H.K., W. Hartlepool; Grand; November 24th, 1900; copyright per- formance." Mr. Hall Caine said the initials "H.K." were supposed to be an abbreviation of his name. (Laughter.) He added that he wished to apologise sincerely to the Court for not having remembered this when he was in the witness-box the previous dav. Subsequently it was announced that an amic- able and satisfactory settlement had been ar- rived at between the parties.
SAVED BY FORCE.
SAVED BY FORCE. When they reached Plymouth six apprentices told an amuoing story of the loss of the liner Periclcs off the Australian coast. When it was believed that all the passengers and crew were safe in the boats, Captain Simp- son decided to have a last look through the cabins before leaving his ship. To his amaze- meat he found a passenger sitting calmly on his bag in the third-caas cabin. The passenger declined to more. "I am en- titled to a salvage reward," he stated, "and it is to prevent me receiving any that you want me to leave the ship." He was removed to a boat by force and per- suasion combined. The ship's cat was placed in a boat, but at the last moment she leaped back to the Pericles, and went down with the liner. I
