NOTICE is hereby given that at the Quarterly Meeting of the County Council for the JLdminittraaive County of Denbigh, held at the County Buildings, Wrexham, on Friday, the i9th day of January, 1897, an Order was made by the said Council (subject to the provisions of the above Acts, and to the Orders of the Local Government Board thereunder) of which the following is a copy:— ADMINISTRATIVE COUNTY OF DENBIGH. The Local Government Acts 1888 and 1894. To the Local Government Board. To the Education Department. "To the Public Works Loan Commissioners. To the Director General of the Ordnance Survey. il To the Registrar General. To the Guardians of the Llanrwst Union. II To the Llanrwst Rural District Council. To the Llanrwst Parish Council. Ii To the Overseers of the Poor of the Parish of Llanrwst. To the Inhabitants of the said Parish. To Hugh Pierce, of Llanrwst, And to all others whom it may concern. "WHEREAS it is provided by Section 57 (i.) of the Local Government Act, 1883, that whenever a County Council is satisfied that a prima facie case is made out as respects any County District not a Borough, or as respects any Parish for a proposal for amongst others the following things. that i, to Buy The conversion of any such District or part thereof if it is a Rural District into an Urban District, and if it is an Urban District i*to a Rural District, or the transfer of the whole or any part of any such District, from one District to another, and the formation of New Urban or Rural Districts, the County Council may cause such inquiry to be made in the locality, and such notice to be given both in the locality and to the Local Government Board, Education Department, or other Government Depart- mant as may be prescribed, and such other inquiry and notices (if any) as they think fit and if satisfied that such proposal is desirable, may make an order for the same accordingly. AND WHEREAS it is provided by Section 59 of the said Act that any Order made in pursuance of that Act may so far as may seem necessary or proper for the purposes of the Order, adjust any property, debts, and liabilities affected by the Order. AND WHEHWAS by Section 51 of the Local Government A.ct, 189-1, it is provided that where a new borough is created or any other new Urban District is constituted then- (sr.).—AH respect- any rural parish or part of a rural parish which will be comprised in the borough or urban district, provision shall be made either by the constitution of a new parish, or by the annexation of the parish or parts thereof to another parish or parishes, or otherwise, for the appointment of overseers, and for placing the parish or part in the same position as other parishes in the borough or district, and (b).-As respects any parish or part which remains rural, provision shall be made for the constitution of a new parish council for the same, or for the annexation of the parish or part to some other parish or parishes, or otherwise for the government of the parish or part, and (c).—Provision shall also where necessary be made for the adjustment of any property, debt?, and liabilities affected by the said creation, constitution, or extension, and that the provision aforesaid shall be made where any other new Urban District is constituted by an Order of the County Council under Section 57 of the Local Government Act, 18S8. AND WHEREAS at a meeting of our County Council for the Administrative County of Denbigh held at the County Buildings,* in Wrexham, on the 31st day of July, 1896, a proposal was made to us, the said County Council, that it is desirable that the District called the Tre'rdre Special Drainage District which now forms a portion of Llanrwst parish should be formed into a separate Urban District, and the same was then referred by us to our Local Government Act Committee, with power to appoint a Committee to hold an inquiry, if satisfied that a prima facie, case is made out. AND WHEREAS at a meeting of our said Council, held on the 30th day of October, 1898, our said Committee reported that they had resolved That they were satisfied that a prima facie case had been made out, and thereby appointed Messrs. Samuel Moss. W. Trevor Parkins, and Thomas Parry a committee to hold the necessary inquiry in accordance with the regulations of the Local Government Board, and to report to them. And our said Council being also satisfied that a primaracie case was made out regarding such proposal, ordered that the necessary inquiry be held as provided by Section 57 of the Local Government Act. 1888. and the Regulations of the Local Government Board, prescribed thereunder and ratified and confirmed the appointment of the said Samuel Moss, W. Trevor Parkins, and Thomas Parry as the Committee to hold such inquiry. AND WHEREAS the said Bamuel Mo?s, W. Trevor Parkin3, and Thomas Parry, and the committee appointed as aforesaid, held the inquiry referred to at the Justices' Court Room,;in Llanrwst, on Saturday, "the oth day of December, 1896, at the hour of 12 o'clock at noon, the Notices prescribed by the Local Government Board to by given prior to the holding of Inquiries under the Section before referred to having been given and published in the manner prescribed by the Order of the Board dated the 14th day of September, 1889. AND WHEREAS the said Committee of Inquiry reported to us that it is desirable that that part of the parish of Llanrwst, known as the Tre'rdre Special Drainage District, should be converted into an Urban Sanitary District "NOW THEREFORE we, the said County Council of the Administrative County of Denbigh, having taken such report into consideration, and in pursuance and exercise of the powers conferred upon us by the hereinbefore recited sections of the Local Government Acts, 1888 and 1891, and of every power us enabling in this behalf, do order as follows, that is to say •' AKTICLK I.. '• That part of the parish of Llanrwst known as the Tre'rdre Special Drainage District, and as the Township of Tre'rdre, shall be an Urban District, and shall be called The Llanriost UrbanDistrict." RTrfiTiK XI •• The'number of Members to be elected for the said Urban District shall be 12. "ARTICLE in. The first election of Urban District Councillors for the said Urban District shall be conducted in accord- ance with the Urban District Councillors (additional councillors and new districts) Election Order, 1895. The Urban District Councillors elected at such election shall, for the purposes of tenure of office and retire- ment, beseemed to have been elected on the 15th day of April, 1897. A RTICLE IV. Of the first Urban District Councillors elected under this order, the third who are respectively to retire on the 15th day of April, 1898, 1899, and 1900, shall be determined according to their place on the poll at the election, those that were lowest on the poll retiring first. If there was no poll, or if a question arises in "consequence of an equality of votes between two or more councillors, the matter shall be determined by ballot conducted under the direction of the Council. "ARTICLE V. T "Hugh Pierce, of Llanrwst, aforesaSd, Clerk to the Guardians, shall be the Returning Officer for the pur- pose? of the first Election of an Urban District Council for the said Urban District. If he shall die or refuse, or through any cause become incapable or unable to act as Returning Officer, then such other person as shall be nominated in writing by the Chairman for the time being of our County'Council shall be the Returning Officer. "ARTICLE VI. The area now comprising the present parish of Llanrwst shall become two parishes, consisting of the area "of the said Urban District and of the portion of the Parish outside the said Urban District to be called "respectively Llanrwst Urban and Llanrwst Rural. Llanrwst Rural shall have a separate Parish Council ".with 7 Parish Councillors, and the 7 Councillors at present representing the Llanrwst Ward on the existing •' Parish Council shall be the members of that Parish Council until tha ordinary day of tho retirement of Parish Councillors which shall next happen after the operation of this Order; and from and after that date the 8 Councillors at present representing the I re rdre Ward on the existing Parish Council aball cease to "be members of the Llanrwst Parish Council. A-RTICLB VII. The persons holding office for the existing parish of Llanrwst as District Councillors of the Rural Dis- "trict of Llanrwst shall, until the ordinary day of Election of District Councillors in the year 1897 act as members of the said Rural District Council; and from and after that day the number of Guardians to be elected for the said Urban Parish of Llanrwst shall be 3, and the number of Rural District Councillors to be elected for the said Rural Parish of Llanrwst shall be 4. ARTICLE VIII. TT „ On the day of the first meeting of the said Urban District Council all rights, liabilities, and obligations of "the existing Parish Council of Llanrwst in respect of the Drainage andlWater Supply of the said Urban Dis- "trict shall pass to and vest in the said Urban District Council and on and after the said day the area of 'the Rural portion of the said parish shall be freed from all liability to any rate or other contribution in respect of any loans which are now a charge upon the area of the whole parish, but until Buch day all the "powers, rights, duties, capacities, liabilities, obligations and property of the said Parish Council, including the Drainage and Water Supply of the said Urban District, shall continue'to be exercisable by, attached to, "and vested in that Parish Council. The Urban District Council of Llanrwst shall, within five years from the operation of this Order, pay to "the Parish Council of Llanrwst Rural the sum of £ 700, and interest thereon at 3%, by equal half-yearly "instalments of principal and interest combined, in respect of the amount levied upon and contributed by the Rural portion of the existing parish of Llanrwst towards repaying the several Loans obtained for the purposes of the Drainage and Water Supply of tho said Urban District. "ARTICLE •As between the Parishes of Llanrwst Urban and Llanrwst Rural, any balance standing to the credit of the existing Parish Council of Lla,nrwst at the date of the operation of this Order, and any debts and liabilities incurred by the said Parish Council other than as specified in Article 8 hereof, shall be appor- tioned between such Parishes m the proportion which tjfceir respective rateable values bear to the valua- tion lists for the whole parish in force at the date of this Order, and shall be paid and borne accordingly. "ARTICLE XI* "Every Officer who, by virtue of this Order or of anything done in pursuance or in consequence thereof, "suffers any direct pecuniary loss oy abolition of office or by diminution or loss of fees or salary shall be "entitled to have compensation paid to him for such pecuniary loss, and in determining such compensation regard shall be had to the conditions and other circumstances required by Sub-Section (i) of Section 120 of "the Local Government Act, 1888. to be had in regard in case of compensation ucder that Section, and the compensation shall not exceed the limit therein mentioned. The County Council shall determine to what "local authority application shah be made for compensation, and out of what fund such compeosation if I "any shall be paid by such authority, and the provisions of Sub-Section 2 to 7 of the said Section shall apply with the substitution of such Authority for the County Council, and with such alterations if any as may "be required. XII. The Overseers who at the date of the operation of this Order hold office for the existing parish of Llan- rwst shall hold office until their successors are appointed; and all future appointments of Overseers, and any appointment of an assistant Overseer for the parish at Llanrwst Urban, shall be made in like manner as if such Darish had been included in an Urban District on the appointed day within the meaning of the Local Government Act, 894, This Order shall come into operation from and after the date of any Order made by the Local Govern- "ment Board for the confirmation hereof.
