Wright, and Colonel Meeham. APPOINTMENT OF CHAIRMAN AND DEPUTY. Colonel Me&ham rose a-nd a-n-nounoed that the magistrates had appointed Sir J. L,don Baukes as chairman, and Mr W. B. Yates eus deputy chairman. Colonel Meshum added th-at ho w sure all wou,d a.w that the appointments were excellent ones in every way. On behalf of the Bar, Mr Ellis Jones Grif- fith, M.P., congratulated the d-eputy cliair- nuan on his appointment, and said that he was able to speak of Mx Yates, not only as his learned friend in a technical senee, but also as his personal friend of many years' standing, lie had known Mr Yatee lor many years, and had learned to appreci.ato th-e courtesy and kindness the members of the Ear always received at his handa, and he was sure that no one was more fitted for the position he now occupied. He also wLsh-id on behalf of the Bar to tender to Sir J. EC don Rankes hearty congratulations on his ap- pointment to his elevated position. It was an honour not only to 14e county of Flint,but to the Principality. The Deputy Chairman thanked the Bar for the remarks made. THE LATE MR P. P. PENNANT. Colonel Mcftham, speaking with great emotion, oaid that it was his duty to propose, on behalf of tie court, a vote of sympathy with Mrs and the members of her fami'v on the death of the late Mr P. P. Pennant. He had to say that tAie Lord Lieutenant (Mx H. R. Hughes, of Kinmel) very much regretted that he was unable to ba present that day, being confincd to his residence with a severe cold. For many years the late Mr Pennant had presided over that court with marked ability and satis- faction to all concerned, and it woud be a moat difficult matter to replace him. His death was a severe loss not only to the county, but to the Principality. Many tributes hed been paid to the inemory of their kite chair- man fiom all sections of the community .end he oould -say that the late Mr Pennant lived and died a Christian gentleman, and they deep- ly deplored his loss. Mr Thorn-M Parry, MoCd, (seconded, and said that the death of Mr Pennant was an irreparable 1(J.. He had lived a notve life, and had given it for the benefit oi the com- munity, to whom, through his unfailing kind- ness and courtesy, he had endeared himse.'f. The excellent services the deceased had rendered to the <■ aur-e of education, and n particular to secondary education, v.ou'd not 00 forgotten, and they hoped that the noble example thus set would stimulate others to follow in the footsteps oi tlwir late chairman. BURGLARY AT ST. ASAPH. David Gwilym Thomas, 2'3, grocer's assist- ant, St. Asaph, pleaded guilty to a change of burglary at the Cross Foxes, Glascoed. St. Asaph, between August 6th and 7th, and with stealing various articles inolud:rg tobacco, a razor, and bottles of stout. Mr Harcvd Edwards (instructed by Mr F. •». Garni in) prosecuted, and Mr Ellis Jones Grif- fith (instructed by M-easrs Evans and Joies, Ruthin) defended. Mr Edwards stated that while the prisoner had at one time in good eirifilo^/rnont, u-nd hed shown gr-cat ability and steadiness, he seemied to have gone wrong. The prosecu- tion, however, hop-2d that if the court con1!] take into consideration the previous good con- duct of the prisoner they would do no. The facts were that he had broken into the Cross Foxes during the mght, and was afterwards found near Tremeirehiou asleep in a held. It was evident prisoner had ken drinking, and he had illad-e a full confession. Miis Williams, a brother4ni-law of the prisoner, said that the young man's relatives had arvanged for him to go abroad, and he prepared to guarantee that that course should be tollowed, a start being given Inni when he wa4s abroad. Counsel urged that the prisoner w".s a. young man who had bæn well brought up, and carne from an excellent family. Prisoner thanked the court, and said he.would behave hi.mseif in future. ALLEGED THEJ<'T OF A HORSE' A TRANSACTION AT RHYL. Jacob Belkield, 30, deader, of f lini^ was Jwi-rged with stealing a mare from, his master at Holywell, a July 13th. Mr Parity probeouted, ind Mr El Us Jones Griffith def. Shortly afterwards while the prosecutor was on his way to Holywell, prkoner overtook him witih the animal, and explained that the smith was too busy, and that he was taking the mare to Hoiy- well to be shed. The money was paid in a. £10 crossed cheque made out to prisoner and 21 in silver, I.at-ar on the police was communicated With, and the prisoner waa arrested in a lodging- houce at Rh.vl with the cherjue and 6s ód. in sil- ver. He denied tiiat he stole the horse, and said that he had aoid it ior his "1».:6," but on the way to the station the prisoner said it was ail tihrough drink. The master and other witnesses were called, a.nd, defending, couneel sought to show that the prisoner hao authority to buy and sell for the prosccutor on com«nission. lino master was asked whether he dd not go to the celi door after prisoner was committed and tell him to "buck up as it. would be all riglit?" Heathcote at Ithyl had a grey mare for sale. The-jury acquitted tho prisoner, and be was discharged. CHARGE AGAINST A RHYL BANKRUPT. A considerable time was occupied in the hear- ing of the charge^ against Jonn iioathcote, 45, hoiie dealer, coach proprietor, and late hotel- keeper, Rhyl, for offcnces under the Bank- ruptcy Acts, it being all-eg-ed in several counts that lie had fraudulently lem-oved L380 of his property. ^Ur ^EHis Jones Griffith, M.P. (instructed by Mr Chuiton) prosecuted, and Mr Dorset, Bir- niingham, with Mr IbroÚI Edwards (ln-jtrucied by Mr Joseph iJoyd) defended. On October 2Sth., prisoner drew the balance of that sum, wh.ch oame to L40,1 18s, there baing- o^.rta.n deductions made. On October 26tli, the two brothers signed a petition in bankruptcy, and at tjjat tiii" tjie pr.soncr iwuf piejfuinably the £ 404 in h;6 jxisa^ssion. On Octo- ber 27th, the. petition was presented and filed at Bangor. The money was undoubtedly the pro- perty of his creditors, but on the night of Octo- ber ioth the pirsoner, with a coachman named Thomas Jonlf", left, lthyl by the 10.5 mail ior .London, and spent two days lit, iNewmarket racecourse, where he alleged he lost all his money. Mr Robt. Henry Edwards, clerk to Mr Cam 1 n, Rhyl, proved that the prisoner signed the shorthand notes cf his puhto examinations, and .0 (`Xp in r-Ply to Mr Doreett said that the notes wc-re StgTied. in I' ebruary, although the bankruptcy wi.s in October. THE OFFICIAL RECEIVER'S EVIDENCE. Mr I Jew Hugh Jones, Oflicial Receiver, pro- duced tne answers given by the prisoner to var- ious questions which gave the story of how the prisoner went to Newmarket races and lost his money. He had suggested at iirs'J lie lost it by ijcitirg, and that he might nave teen robbed. i r.sorKr had offered to pay Messrs Irwen out a* the raw of £ 10 per month, but that offer was declined. He said, that he went away as the crtditors were flocking round him lilie a flock of sheep. While he was in London he said he \vas drinking, end did not lave anvthing to cut. In all, he reckoned that he had "lost at New- market about £320, In reply to questions as to why he did not know what he was doing, th? prisoner replied that a drunken man would do a lot more silly thing:} than if he were sober. In ero the Ofliciai R-civcr said that no doubt the prisoner was under ex- amination for about hours, but his brother had also been examinee! at the same time, one go.ng out while the other was examined. He was not prepared to ac-:e}>t the inter]X)lation that it was An Inquisition" putting a man through an examinat.on. Before th: rrioouer Ð:1t hproeo to 1 lie t-rewe sale he had s<c."hi some at Mr frank Lloyd's sale, and. the prisoner did not have a penny of that money, settling up w;th Mt Llo.wl so far as the proceeds went, but still leaving Mr LQyd a large creditor. It was no doubt the custom of d" coaching proprie- tors to sell their hor.ses at the end of the sea- son, a.r.d pr soner had followed Ltc custom. With the exception of a few s;mall prisoner had not sold anything else just before his bank- ruptcy. lie w.th his brother had occupied two farms. All the stock was sold:, but ho was not prepared to Kiy that the total reaJiscd was £ 2500. l!he liabilities had been put down at ±>4515 gross, and expected to rank at £ 4194. The estimate of the assets was £ 3334 besides other things.. The estimate was at a knock-down pr.ee. He was not prepared to agree that ii the aPÐd.;s had been refused as a eoing concern, that 20s in the £ would have been paid, even it cost, were taken, as horses, coaches, etc., would not realise cost price when afterwards sold. Pr.,goner had been in business many years, and had suceeeced his father. No doubt pri- soner was well-respected, and all he had against him was that he had had £ 404 which he had not handed over to his creditors. He had taken proceedings aga'nst the prisoner, and the Judge of the County Court had sent hvn to prison for I about 17 days, Ix-mg bet at liberty on giving a bond to make disclosures and sureties Trustees and a committee of inspection were appoinied, but they were not consulted as to the prosant proceedings, he (witness) conducting the whole matter so far as the examination of the prisoner was concerned, the estate being realised by the trustees and oom-nittee. From the time1 of the examination, signing of tie notes, etc., until July 11th, no proceedings were taken against the prisoner. Mr Ellis Jones Griflitlh asked the reason, and the Official Receiver said that he was in- vestigating mattoirs, and he did not wish to launch a prosecution until those tilings had been investigated. There had been matters connected with transaction as to the removal' of horses by night. That was the reason, for the delay. On July llt.h the County Oourt Judge oidered those proceedings to be taken. VISIT TO NEWMARKET. Thomas Jones, 26, Krnest-street, Rhyl, who had !xüu in the prisoner's employ for about 20 years, was then called to give evidence as to the visits to Newmarket with the prisoner. lie could not say that h:s own betting transact ions had not. been a success at Ncw-market, as he jverscriaily backed a winner. Prisoner was throwing h s money about recklessly. In cioss-examination, the Witness said Uu.t the prisoner at one time had had as manv as 70 to 80 horees in his businesa with sufficient vehicles to work them. When the •horses were aold by Mr Frank Lloyd and aho by Messrs t av<.s tJiev were wdl advcitUj-cd lot:aiJy, and also throughout the country jn the prisoner's name. Ihcre was no atcrccv about the sales, which were t-h-e usual after- seaeon sales. Prisoner had had a lot of trouble; he had been drinking heavily, had been ill, lost his wife, and had had a bad season..Beiore they went to London and on to Newmarket the .prkoitcr said that-he was in trouble and was going away unflfil it had blown over. Prisoner had been ill ior some months prior to that. Aiter the execu- tion was put in people got wind of it, and were running in end out all the time; that was why prison-er warned to get awiy until it had blown over. During the whole time prisoner was in London he wes under: tho mfluenoc of drink. I M j > a i" m ■■■■ i ■ MT Dorcett; That might be an extra trouble (laughter). Evidence was then given by T. Jock&on White house, clerk with Messrs Caves, as to prisoner receiving £4.04 -in gold, prieoner eaying he preferred it in tlrat form. In re- ply to Mr Dorsett, the witness said that the, prisoner said he wanted the money in gold as hoh ad men to pay, ar.d he did ivay men for the work they had done. All the horses were extensively Y advertised in the prisoner's in Rhyl and elsewhere. There was no secrecy about the matter, as it was tiie usnau after-season sa-le. Samuel Irwen, Old Tnafford, proved issuing a writ against the prisoner, and in cro;:s- examination he said Jus family had dealt with the prisoner fox 20 years, and no doubt they had had thousands of pounds in transactions with him. He did not agree that in this case he came down suddenly on the prisoner, as he had promised to pay £ 20 a. month, but was many months in arrears with his payments. In reply to other questions, the Witness said he was no party to the prosecution, al- though he acted on the oommittce of inspec- tion. By Mr Griffith He meant that he (lid not issue the writ early enough, as it was de- stroyer! by the bankruptcy. He had had 4s in the X dividend. THE DEFENCE. Mr Domett, for the defence, said that he was sure that the jury wou2d be surprised that .after the prisoner had been once sent to prison by the Judge of the County Court he should be again brought before a court. It was not the creditors who had prosecuted, nor was it the trustees or committee of inspection, but it was the Official Receiver who stood on his own in the matter, and no doubt con- sidered it was his duty to act as he had done. The creditors, he submitted, by standing aloof from that prosecution showed that they considered that the prisoner was not a man who should fie pros-ecu ted, otherwise they would have taken action. It was for the jury to find whether the prisoner had been guilty of fraud, and he urged that they should not mistake foolishness for fraud. He submitted there was no evidence of inten- tion to defraud the creditors. In the finst ■place the prieoner made a statement to the Official Receiver, and because the latter be- lieved the statement was not correct he had the prisoner sofCnt to prison for some 17 days, yet alter many months of investigation the prisoner was now being prosecuted on that very statement, and because the Official Re- ceiver now believed it was true. No doubt it was a foolich and stupid act on the "art of the prisoner to go to London, but he was not to be found guilty of fraud on that account. They had hetard how the prisoner had had trouble on every hand, but he never had any intention to defraud his creditors. It was true that prisoner had got rid of the money, but he did not reap any advantage from it. It might fiiave been reckle&s con- duct. but it was not fraud, and had. he backed A rran mor e at the ivewraarket races with .£100 and returned a winder at 10 to 1 would not the creditors have patted him on the back, and rejoiced that, he had money with which to pay them? Then again tihe estate had realised a considerable en TO, and a dividend of something like 4s in the £ had been paid realised a considerable eum, and a dividend of something like 4..s in the £ had been paid out of an estate which, he contended, realised about 10s in the £ He asked the jury to say that the prieoner had not been guilty oi fraud. THE SUMMING UP. In summing up, th-e Deputy Chairman said lie wished in the ikest place to say that Uie jury had to remember that the Official Re- ceiver was an officer of the court, and tihat it was his duty to look after the interests of the creditors generally. The inquiries held by him were in the course of his official duties, and as a result of his going into matters the Judge of the County Court ordered those proceedings. After reviewing the evidence the Deputy Chairman said the jury had to remember that it was suggested that the prisoner was drunk when he did what he did, but one was struck with what had happened. It must strike any reasonable man that whoell a man went to hils solicitor to sign a bankruptcy petition he must be I.e- sumed to liave been sober, or his solicitor would not have acoeptod his .signature. Ilavin,g £ 300 odd in his poem-esion at the time why did not the nritoner pay out the execu- tion F If the execution was the cause of the trouble had he not the means iai his hands to have got rid of it? But -co, the prisoner went and fikd his petition at eleven o'clock in the morning, ard went off to London with the money at night. The jury had heard the story of what happened in h-ovidon and at Newmarket,, and they had to remember that it was not his own money that the prisoner was playing with; it was money L that belonged to his creditors ;us his petition had been filed. It struck one as rather startling that a man should say that he had foolishly and recklessly got rid of money wHiic.li did not belong to him and then to turn round and say it was not fraudulently done. It was a matter entirely for the jury to say from the whole of the facts whether or not it was fraud. The question was whether or not the prisoner had acted fraudu- lently in getting rid of the money. The jury retired., and after an absence of about 15 m nutes thov returned to court when the Foreman sa d they found the prisc-ner guiity of fraudulent intention. The Deputy Chairman asked whether the jury meant that he was guilty after the bankruptcy petit .on was presented. The Foieiuan Yes. The Deputy Chairman: On one count only you find him guih! The Foreman Yes. The Deputy Chairman And you say he is not guilty on the Oliver counts? The Foreman Yes. Prisoner was then sentenced to two months' imprisonment, without hard labour. Mr Jiierwj.'tt: You mean in the Second Divi- sion ? The Deputy Chairman i Where no hard' labour is given. UNSUSTAINED CHARGE AGAINST A PRESTATYN VVOMAN. ACCUSED ACQUITTED. Mary Susannah Beaummf, 48, a married woman, of Prestatyn, was charged with unlaw- fully obtaining credit from Edward Purnell by means of fraud at Prestatyn, on trie 2nd and 3rd of August. There was a second count of falm pretences, and to each the pri- soner pleadied "Not guilty." Mr Harold Edwards (instructed by Messrs Hughes and Gy-seoyne) prosecuted, and Mr Ellis Jones Grifiith (instruct* by Mr Joseph Lloyd) defended. Mr Edwards said that the proceedings were taken under the Debtor's Act of 1869, and while a person might obtain credit without intention to defraud it was a criminal ofence if it could be shown by the prosecution that there had been a syntern by which the credit was obtained. Mr Ellis J. Griffith suggested that that point should be deferred usritil late in the case for argument,, and that Mr Ed wards should confine his opening remarks to the mere facts of the c.aÐ? L Mr Edwards then proceeded to state the nature of the case as would be pieced before tlie court by Mr Purnell, a' when proceeding to outline the evidence of t.e other witnesses, Mr Ellis J. Griffith objected, and contended that the profeoution we *e not in a position to go into any other matters until the first case was proved-. There was only one cas-e to be dealt with that day, and that was the case of Mr Purnell. Mr Edwardis oc-ntendted that he was entitled to show by other evidence that there was no mis- take in the one ease. The Deputy Chairman considered it would be safer to deal with the facts of one case first.. j tiharles Edward Purnell, ironmonger, Presta- tyn, said that, on August, 2nd the prisoner came to his shop and appeared to be a lady of means. She said she had taken, a house from Mr Maine, who wa It cus- tomer of witness. He suggested that he should send the tilings down later in the day, but she asked for them to lie sent at once, and he did, to, but the boy only brought back an empty truck (laughterl He had expected either the money or the return ai the articles. In leply to the Deputy Chairman, the witness said he took Mr Mane as a reference because he was a customer. He further oon- that the onus of proof of lack of means and the intention to defraud icsted ¡ with the prosecution, and they had failed to prove their case. A legal argument followed cs to the cases on the point, and the Deputy Chairman said ho agreed that the count as to a.1.w ore- tenoes mmit go, but othexwise he thought it a ease for the jury. Mr Griffith, in his address to the jurv. said no doubt they had imagined that there w-aa a great deal in the case, but the total amount spoken to by witnesses was only £ 20. If a man was to b? charged with obtaining credit by fraud, if a number of tradesmen suddenly pressed a. person for t2,3, he was afraid many would be guilty of fraud. He contended that it ,a. not a ease for a criminal court. The fed, of the matter was that the Prestatyn tradesmen got frightened. They did not even wait for the money, which he hoped even now would be forthcoming, but suddenly conceived the a that the woman was dishonest. He was sure that the jury would not place upon the prisoner the indignity of sending.her to prison fox a civil debt. Tlie jury returned a verdict of "not guilty, and the prisoner was discharged. The Master was authorised to eon/or with the boy's present schoolmaster with a view to his becoming a candidate for a scholarship. MEETINGS OF THE CONTRACTS COMMITTEE. A moton by the V.ee-Chairman that in future the meetings of the above committee be held on the Board (morning instead of another day led to considerable dirjotission. The mover said that I if they met at 9.30 a.m. they would have two clear hours before the Board meeting to go through the tenders submitted. The attendance was always very poor when any day other than the Board day was selected for a. committee mooting,, and as was recently the case, there was the further disadvantage and danger of in- formation getting; to the public prematurely. Mr Hagh Williams seconded' the motion. Mr J. Eliis Jones said he was opposed to the motion b. the consideration of tenders immediately before, a Board meeting meant the rushing of the business. As to the complaint of in.formaton getting to the public pre,mature- ly, he did not think they need trouble about that matter any more, after the recent '"bit of burst. It ought not to be too much for any- body really interested in his work as a Guar- dian to once or twice a yar attend a commit- tee .meeting a day or two before the Board day. Mr R. Parry Jones, the one person who originally tendered, and who supplied the meat dtrring tlie last half-year. Mr Parry JoiiC3 contended that he had not been, prop-rly treated in the matter, and thought he, had good ground of complaint. His contract for the last six months was at 4gd per lb. He nad absolutely no complaint, in regard to the quality of the meat, and he did his best to fulfill his. contract faithfully, and was certain that he mora than succeeded in supplying the good quality of meat. The Workhouse- Master said the quality of the moat was satisfactory, and that he had no complaints whatever. lie (Mr Parry Jones}- therefore could not understand why the Master,, according to tho" Pioneer" report, should say at the open Board about "having had to be- satisfied with the meat they received, and that, he questioned whether they had as good meat- sis formerly." That was a serious reflection on. him who was supplying very large quantities of meat on contract to public institution. Mr Parry Jones further wrote that he had another ground of complaint.
