Wha they had to consider was, not whether the charge was well founded or not, but. whether the defen- dant believed it to be so. He could not foresee what might happen at atri ii. For inslarce, in this very case the ccuoty-court action and the trial at the assizes lasted three days, and how was it possible for a prosecutur to anticipate all tiie evidence w hich might be offered or the decision to which twelve men "llo. names he had never heard be to. might cr-aw In the case before them there might be differences of fact and differences in evidence. They would, therefore, hnve to decide co the subsidiary facts, but he thought it best in that case that it should come further before him for his decision as to whether there was reasonable and proper cause for the prosecution. His lordship then reviewed the whole of the evidence, and put two questions to tne jury, first, whether they believed that beiore t.ving action the defendant believed the testimony of his witnesses, and, secondly, whether they were wit- nesses on whom he could nly, and whether he had an honest intention in prosecuting the plain- tif!! :-The jury returned ar.SWtrS in tne affirma- tive, and his Lordship upon them ruled It there wa. reasonable cause for the prosecution, and gave judgment for defendant, with costs.
