Die pute as to Sale of Land…
Die pute as to Sale of Land at Denbigh. RESULT IN COUNTY COURT. At the Ruthin County Conrt on Tuesday a case was heard, the plaintiff being David Lloyd, of the Vale of Olwyd Timber Com- pany, Denbigh, who chimed from Mr J doiUnd Roberts, solicitor, Denbigh, £,15, being the amount of a deposit paid in refpct to the proposed transference of land by contract from the defendant to plaintiff Mr Clement Davi'S, b»rrigter-at-hw Cntlue ed by Messrs A 0 Evans & Co, Denbigh) represented plaintiff, and the def ndact conducted bis own case. Mr Ditvies said the sc ion was for the recovery of the said X45, and also for setting REide a contrscl; for the stle by •rVerdmt to j 1 iint if of land in Red Line, Denbigh, containing 1 559 equire yards, t e purchase price agreed b ing £ 200. On hchalf of the plaintiff, he admittEd that a contract was entered into for the sale of tbe property, but tbe question was whether cr not the contrrc1; was dissDlved oy agree- ment entrred UpJD between the defendant i nfl Mr A 0 Evans acting on bebslf of the plaintiff. This, he argued, was really what took p'.sC'j, hence the present ac ion. The uautl deposit of 10 per cant, was not observed in this csø. Iaet ad, £ 35 had b3E'fi paid, leaving a bahnce of £ 165 due. Tho date of completion wai to be February 1st, 1913, but plaintiff wanted that matter to be put off for a time, and tbe defendant agreed on condition that £35 bo paid as dcpost. the d 4te of completion being fix d for the 1st of Feb uiry, 1014, the defend- ant agreeing to prepare the cjavtyaucs free of einrge. When the list-mentioned day arrived, p'aintiff apparjntly was not ready to complete tha contract and asked for an extension of tiui-j until the 29.h of June, 1914 Thij was agreed to, the plaiu ilf paying an extra d poa t of £10, aiiking the total p-iid £45, tbe sum now claimed by the plaintiff. That was ths I posi ion until some time in April, when a local ^entiemsn, ia a coiversation with pl.iatiif, suggested that the defendant himself was not in a poaition i) complete the eonirac. Tbo plaintiff subsequently consulted Mr A 0 Evans, his solicitor. Cjrrespondeuce and interviews ensued, and, counsel contended, it was agre d between the parties that the csntraci bs d clared off, the defendant on his p tri; agreeing to refund the t45 deposit money paid. This he hid not done, bonce the present claim. Evidence in support of the above state- ment was given by the plaintiff and Mr A 0 Evans, both stating that the defendant, being himself unable to complete the con- tract, agreed to refnnd the neposit money. The defendant, giving evidence, said the plot of land in question formed parb of pro- perty which be bought for £ 540. There were other persona interested in ir., and on that account be required a definite date fixed for the ooospletiblon ot te contract, so that he might give the necessary notices to give op the land, or to transfer the existing mortgages. Juab prior to Fdb. lit, 1914, the date fixed for the completion of the contract, Mr Lloyd informed him that he was Dot ready to complete, and the date was postponed until tbe 293h of June. Nothing transpired until tho 2id of May, when be received a letter from Messrs A 0 Evans & C j abklcg him to call at their cffice. He dii so, and. to his 6arpri:e, Mr Evans stated that he had information that witness was not in a position to complete the con- tract, He replied that be was, bat omitted to inform Mr Evans, aa he should have done, that the completion was not to take I place nntil the 29,h of June. 011 the saore day, bat in another place, ho again taw Mr Evans and asked him what Mr DJ L'oyd wanted-fpwhether hs desired to go on w th tha contract, or did he want h's no ey bick. Mr Evans relliel, "He wants hii money back." Witrees premised to 8:e what he could do, and subsequently saw Mr Lloyd. The latter made s ime remark to the effect that the deeds ha I not been pre- jared, and witness omittel to poxt out that they need not be ready until the 29 3h of Jcne, which he sfcoa'd tavo done, and 'or which date he was arranging matteri. Correspordeue) en^ce1, and Messrs Gold Edwards & Co, as representing the 11 st mortgagees, were consulted. PrcceeMng, Mr Holhnd Roberts said the property was bought for 2510, bub extec- sive alterations were carried out which in created tbo Vilae considerably* Daring the whole of the transactions he had been tully prepared to complete the contract on the date originally fixed, acd on the 29 ih of Jane, and had not agreed to cancel it or to refund the deposit money. His Honour, after reviewirg all tin cir- cnimtances, came to the conclusion that tbe defendant had agreed to the cancelU tion of i fce contract n 1 t ) refund h eep -,sit, The long cer, espondence tended to show that both sid< a regarded the f o 1. t-raot at an end. He h^r jfore gave j tdg. ment for the plaintiff for the £-\5 a \d ordered the agreement to be hacde] up o the Court for cancellation, costs 10 follow. L ■—»—*

"THE HOMES THEY LEAVE BEHIND."
"THE HOMES THEY LEAVE BEHIND." We have received a copy of a scng entitled The Homes they leave Behind," which hss jist been published by Messrs Enoch & Song, for the benefit of the National Relief Fond. As the tible clearly indicates, the song is one of direct appeal for snpport to the fond and should help it mucb. for Mr Walter Rubens' music is of a tuneful and catchy nature, which will, it is believed, gain wlle popularity, while Mr Harold Bagbib's words should arouse ready sympathy. Twenty-five par cent o! the profits of the song are to be given to the Variety Artistes Bonevolant Fund, an ar- rangement which should assist a great deal in popularising the song. We Cf D com. mend the song and music to all lovers of a good patriotic song with plenty of g) and fine spirit In it. Any book eler or mu io depot will supply U.
